BAINBRIDGE, Ga. – After months of going back and forth through legal battles, the Georgia Court of Appeals has ruled in favor of Safer Human Medicine (SHM), the company over the monkey facility set to come to Bainbridge.
Back in June, Decatur County District Attorney Joe Mulholland brought his concerns about the legalities of the project to the Court of Appeals. In a legal brief Mulholland filed, he said the trial court should be reversed, and the Validation Order should be vacated in the project.
SHM has continued to argue the project was properly approved by city and county officials.
In the Court of Appeals’ new ruling, they said they ruled in favor of Safer Human Medicine “Because the State petitioned the trial court for the bond validation, it cannot bring an appeal from the trial court’s order granting that petition.”

They also stated “…at the appellate level one cannot complain of a judgment, order, or ruling that his own procedure or conduct procured or aided in causing. The trial court granted the State’s petition to validate the bonds at issue. The trial court’s order, therefore, provides no basis for the State to appeal, and this appeal must be dismissed.”
